OSLS, Vol 8, No 6 (2018), “State of Exception, Law and Economy: A socio-legal approach to the economic state of exception in an era of crisis”

Image result for state of exception

Departing from a critical understanding of the relationship between state, law and power, we propose a critical overview of the concept of the state of exception developed by Giorgio Agamben. We emphasise the idea that the principle of legal exceptionality is not as merely used in response to the current crisis in capitalism, but is an enduring and core technique of power used by states to reproduce economic and colonial power relations. Thus, this paper offers three core points of departure from dominant understandings of the state of exception. First, we urge a rupture of the crude opposition between positive law and the state of exception. Second, we argue for a rejection of limited Western concept of (liberal, political) rights. Finally, we argue for an attention to the materiality of power relations, rather than a narrow focus on the power projected by formal institutions of state power.

Law and Society 2019 Junior Scholars Workshop Application

law and societyThe Law and Society Association is pleased to accept applications for the 2019 Junior Scholar Workshop. The workshop will begin mid-day on Tuesday, May 28, and continue through the day on Wednesday, May 29, 2019. The workshop immediately precedes the 2019 Annual Meeting of the Law and Society Association in Washington DC.

We invite applications from junior scholars in any field whose scholarly interests involve socio-legal studies. Specifically, we welcome applications from graduate students (including advanced law students), post-doctoral fellows, and assistant professors (or other pre-tenure faculty). The program will consist of panel presentations on professional development topics, breakout sessions to discuss participant’s research in small groups, and informal discussions over shared meals. The goals are to build intellectual community among the emerging next generation of Law and Society scholars, to foster collegial networks between junior scholars, and to promote constructive dialogue among participants and workshop facilitators about junior scholars’ individual research projects.

Previously, the Junior Scholars Workshop entailed separate Graduate Student Workshop and Early Career Workshop. Recognizing the continuity in challenges and opportunities facing graduate students and early career scholars, as well as the importance of encouraging connections across ranks, this year, we have combined these workshops into one workshop in which a range of junior scholars can learn and discuss together.

Note that an individual student may only participate in two workshops during his/her graduate career and two workshops during his/her early career. For those not reimbursed by their home institution for airfare and lodging expenses, LSA will offer up to $300 for participants from the US and up to $650 for international participants toward the costs of attending the workshop. Although membership in LSA is not required, members will be given priority. Registration for the annual meeting is required (NB: registration deadline is 2/1 for participants on the meeting program).

Please complete the submission form by January 15 to be a part of the 2019 Junior Scholar Workshop. The LSA workshops have a competitive application process, and those applicants selected as members of the cohort will be informed prior to February 1, 2019.

Applications require:

  • Application form
  • A current curriculum vitae
  • 1-2 page letter describing the applicant’s research interests (including an in-progress paper, chapter, or proposal/prospectus, a draft of which they would like to present at the workshop), current status in the applicant’s career stage (i.e., current stage in graduate school, duration of post-doc, year as faculty), and how attending the Workshop will benefit the applicant.

All supporting documents must be submitted in English and be in .DOC, .RTF, or .PDF format.

Law and Society 2019 Herbert Jacob Book Prize

law and societyEstablished in 1996 as the LSA Book Award, and re-named in memory of Herbert Jacob, past President of LSA, the competition is open to books from all fields of, and approaches to, law and society scholarship—excluding only works of socio-legal history, which are considered for the Hurst Prize.

Herbert Jacob was the founder of the first internet book review in the field, Law and Politics Book Review. He was a creative, energetic scholar who took on a wide variety of questions and issues and a warm human being whose own work has been a major contribution to the field of law and society. The award is intended to recognize new, outstanding work in law and society scholarship.

Textbooks, casebooks, and edited collections are not eligible for the award, but monographs will be considered. Nominations are accepted from all aspects of the field and any country of origin and may include first books of young scholars and books that are capstones of long careers in law and society research and publication. Nominators must be a current LSA member (will be verified). Self nominations are accepted.

The responsibility of ensuring that a work is submitted for the most appropriate book prize rests with the nominator. As a rule of thumb, books that have a significant historical focus should be directed to the Hurst Prize, while other works of socio-legal scholarship should be directed to the Jacob Prize.  A book submitted for both prizes may end up being considered for neither.

The award carries a cash prize of $500.

Nominations require:

  • To stress the restriction stated above, books eligible for the Jacob Prize may be from any field of socio-legal scholarship except history; books with a significant historical focus should be submitted instead to the Association’s Hurst Prize.
  • Only one single-authored work by the same author in a given year will be accepted. Two works by the same author will be accepted if one or both works are jointly authored.
  • Books must be published in English, or be English translations of original works.
  • Books submitted must have a publication date during the calendar year prior to the award ceremony.
  • Page proofs may be sent if the book will be published soon with the proper year’s date.
  • A letter of support from the nominator, including a synopsis of the book.
  • Only nominations from an LSA member will be considered. Self-nominations are accepted.
  • Copies of the book are required to be sent directly to the Herbert Jacob Book Prize Committee Members. Addresses will be provided after the nomination is submitted.

All supporting documents must be submitted in English and be in .DOC, .RTF, or .PDF format.

Deadline: January 18, 2019.

Call for Papers – “The Protection of Cultural Heritage and Municipal Law”

It is open the call for paper proposals for a works-in-progress workshop on “The Protection of Cultural Heritage and Municipal Law.” The workshop will be held at Fordham University’s School of Law, in Midtown Manhattan, New York City, on Friday, April 5, 2019. It is invited by The American Society of International Law’s Cultural Heritage and the Arts Interest Group (CHAIG) and Fordham University School of Law’s Urban Law Center, in collaboration with the Quebec Society of International Law (SQDI).

The protection of cultural heritage has long been understood as the province primarily of international law, but this workshop will highlight the place of municipal or local law in the discourse, exploring continuities and discontinuities with international law. Do international law and municipal law draw on each other’s strengths? Do they  complement each other in terms of their shortcomings? Do they connect, or are they disconnected, in practice? While international law is addressed to nations, local governance is highly relevant to the protection of cultural heritage, and yet sometimes working in silos from other cities, provinces or states, as well as national governments.

Paper proposals of no more than 500 words should be sent to  sabrina.tremblayhuet@usherbrooke.ca before Sunday, December 30th, 2018. The authors of the selected proposals will be notified by Friday, January 18th, 2019. Proposals from emerging scholars and graduate students are highly encouraged. Draft papers must be submitted no later than Monday, March 18th, 2019, for circulation to the selected participants in preparation for the workshop. Please note that no funding is available to cover transportation and accommodation for participants. Attendance at the workshop is, however, free of charge, subject to prior registration. Lunch will be provided to workshop participants.
